Sonnenreisen GmbH General Terms and Conditions of Business
Dear Customer,
these General Terms and Conditions of Business (hereafter referred to as “T&Cs”) of Sonnenreisen GmbH (hereafter referred to as “Sonnenreisen GmbH”) govern the relationship between you (hereafter referred to as the “customer”) and us; accordingly we request that you read them carefully and contact us if you have any questions or are unsure of anything.
As part of its bus hire business, Sonnenreisen GmbH offers the following services: transfer services, day trips on demand and multi-day trips on demand. The following T&Cs apply to these activities. By booking/using our services, the customer expressly accepts these T&Cs.
The reservation becomes legally valid following the customer’s acceptance of our quotation and subsequent confirmation by Sonnenreisen GmbH. Our confirmation does not need to take any particular form.
Payment
For the hire of a vehicle plus driver, the following payment terms apply:
- 30 % deposit upon confirmation of booking
- Remaining payment after the service has been provided
Withdrawal / Cancellation
For the hire of a vehicle plus driver, the following cancellation terms apply:
- In the event of a short-notice cancellation 48 hours or less before departure, a cancellation charge of 80% will be made. If you fail to show up for the departure without giving prior notice, the full cost of the reservation will be charged.
Complaints
Should there be any shortcomings in the performance of the service, the customer is obliged to notify Sonnenreisen GmbH immediately in order to enable us to assess the complaints and remedy them where necessary. If you neglect to notify us immediately, there will be no entitlement to compensation.
Passport / Visa / Health regulations
In the case of international journeys, customers are required to carry a valid form of identification. Underage children may only travel across international borders if accompanied by a person with parental authority for them. In the case of international journeys the customer is also obliged to adhere to the corresponding customs and import regulations. They are required to inform themselves independently of these.
Liability
Sonnenreisen GmbH is liable, within the limits of the law, for any damage to persons or property that may be incurred. However the following express exclusions of liability apply:
- Loss of personal property left behind in the vehicle;
- Loss/damage to property not usually transported in luggage;
- Loss of means of payment of all kinds;
- Visible damage to the luggage and damage to handles and wheels.
In the case of damage caused culpably or negligently by the customer himself/herself, he or she shall lose any entitlement to compensation from Sonnenreisen GmbH.
Cleaning
In principle, cleaning costs for the vehicle are included in the quotation price; in the event of culpably or negligently induced excessive soiling of the vehicle, the additional cleaning cost will be charged separately as a lump sum of €100.00.
Driving time / Breaks
Our quotations are drawn up taking into account the detailed time specifications of the customer and in compliance with the statutory driving and rest times. The agreed departure times must be complied with accordingly. If, as a result of delays caused by the customer, it should no longer be possible to adhere to the statutory driving and rest times, then the journey must be interrupted and - where possible - the party must wait for a replacement driver. The costs incurred as a result will be passed on to the customer as follows: Flat rate: € 200.00 plus € 50.00 per hour of time required for the replacement driver. In the event that the driving and rest times are affected by force majeure or through the fault of Sonnenreisen GmbH, no additional costs will be incurred by the customer.
Severability clause
Should individual clauses of these T&Cs be or become wholly or partially ineffective or invalid, this shall not affect the validity of the remaining provisions.
