General Terms and Conditions of Sonnenreisen GmbH
Dear Customer,
The following General Terms and Conditions (hereinafter: "GTC") of Sonnenreisen GmbH (hereinafter: "Sonnenreisen GmbH") govern the contractual relationship between you (hereinafter: "Customer") and us. Please read these terms carefully and contact us if you have any questions.
Sonnenreisen GmbH offers the following services as part of its rental bus services: transfer services, day trips upon request, and multi-day trips upon request. The following GTC apply to these services. By booking or using our services, the Customer explicitly agrees to these GTC.
The booking becomes legally valid through the acceptance of the offer by the Customer and the subsequent confirmation by Sonnenreisen GmbH. A special form of confirmation is not required.
Payment
For vehicle rental with a driver, the following payment conditions apply:
- 30% deposit upon booking confirmation
- Remaining balance after service is provided
Waiting Times and Additional Unagreed Kilometers
For regular trips, the waiting time tolerance is 30 minutes. After that, an additional charge of €50.00 to €100.00 per started hour will be applied. For airport transfers, a tolerance of 1 hour applies.
For additional, unagreed kilometers, a surcharge of €1.60 to €2.00 per kilometer (depending on the bus size) will be charged.
Cancellation/Withdrawal
In case of cancellation by the customer, the costs already incurred, at least €35.00 as a processing fee, must be reimbursed. In addition, the following cancellation fees will be charged:
- From 21 working days before the appointment: 10%
- From 14 working days before the appointment: 40%
- From 7 working days before the appointment: 70%
If the cancellation occurs on the day of the appointment or on a Sunday or public holiday immediately before, the cancellation fee will be 90% of the agreed fee.
For short-term cancellations within 48 hours before departure, a cancellation fee of 80% of the total price will be charged. In case of no-show, the full price will be invoiced.
Complaints
Any deficiencies in the provision of services must be reported to Sonnenreisen GmbH immediately to allow for verification and, if necessary, rectification. If the Customer fails to provide this notification through fault, no claim for compensation will exist.
Passport, Visa, and Health Regulations
For cross-border travel, customers are required to carry a valid ID card. Minors may only cross the border when accompanied by a legal guardian. The Customer is responsible for complying with customs and import regulations.
Liability
Sonnenreisen GmbH is liable within the scope of the statutory provisions for damage to persons and property. However, liability is excluded in the following cases:
- Loss of personal items left behind in the vehicle
- Loss or damage to items not typically transported in luggage
- Loss of payment methods
- Cosmetic damage to luggage and damage to handrails and wheels
The Customer loses any claim for compensation in the case of self-inflicted or negligently caused damage.
Cleaning
Cleaning costs are generally included in the offer price. In the case of intentional or negligent excessive soiling, a cleaning surcharge of a flat rate of €100.00 will be charged.
Driving Times/Rest Breaks
The offers are based on the schedules provided by the Customer, considering the legal driving and rest periods. The agreed departure times must be adhered to. If a delay prevents compliance with the legal regulations, the trip must be interrupted and, if necessary, a replacement driver must be waited for. The cost in this case is: Base price €200.00 plus €50.00 per hour of waiting time for the replacement driver.
Severability Clause
If individual provisions of these GTC are ineffective or void, the validity of the remaining provisions will remain unaffected.
Jurisdiction
The place of jurisdiction is Bozen.
